Holon LLC Privacy Policy

This Privacy Policy explains how Holon LLC (“we,” “our,” or “us”) collects, uses, discloses, and protects personal information when you visit holonsound.com (the “Site”), place a pre-order, or otherwise interact with us. By using the Site you agree to this Policy. If you do not agree, please do not use the Site.

1. Scope of this Policy

This Policy applies to personal information we collect from visitors to the Site and from customers who place pre-orders or interact with our customer support, marketing, and social media channels. It does not apply to third-party websites, apps, or services that we link to or that are operated by other companies; their privacy practices are governed by their own policies.

2. Information We Collect

2.1 Information you provide to us.

When you place a pre-order, an order, create an account, sign up for marketing, or contact us, we collect:

  • Identifiers and contact information: name, email address, postal/shipping address, phone number, and account login credentials.
  • Order and transaction information: products purchased, deposit and balance amounts, order date, shipping preferences, and order history.
  • Payment information: payment card last four digits, card type, expiration, and billing address. Full card numbers are entered into and processed by our payment processor (e.g., Stripe, Shopify Payments) and are not stored on our systems.
  • Customer support and communications: messages you send us, survey responses, social media interactions, and call records (where notice is provided).
  • Marketing preferences: email and SMS opt-in status, channel preferences, and unsubscribe history.

2.2 Information we collect automatically.

When you use the Site we (and our service providers) automatically collect:

  • Device and connection data: IP address, browser type, operating system, device identifiers, language, and time zone.
  • Usage data: pages viewed, products viewed, referring URL, click-stream, scroll depth, search terms entered on the Site, session duration, and timestamps.
  • Cookies, pixels, SDKs, and similar technologies, as described in Section 6.

2.3 Information we receive from third parties.

We may receive information about you from:

  • Payment processors and fraud-prevention providers (transaction status, risk signals).
  • Shipping carriers (tracking and delivery confirmation).
  • Advertising and analytics partners (engagement with our ads, audience attributes, conversion events).
  • Social media platforms when you interact with our pages or use a social login.
  • Service providers that help us with email/SMS deliverability, customer support, and identity verification.

2.4 Sensitive information.

We do not intentionally collect government IDs, biometric information, precise geolocation, racial/ethnic origin, religious beliefs, health information, or other categories of sensitive personal information. Please do not submit such information through the Site.

3. How We Use Information

We use personal information for the following purposes:

  • Provide and operate the Site, process pre-orders and deposits, charge balances, manage segregated-account funds, ship products, and provide customer support.
  • Communicate with you about your order, including delays, balance-charge notices, shipping, and the 60-day money-back guarantee.
  • Send marketing and promotional messages by email and, with your consent, by SMS, including announcements about the product, launches, and offers.
  • Personalize the Site and our marketing, including showing you ads on third-party platforms based on your interests and engagement (see Section 6).
  • Measure and improve the Site, our products, and our marketing through analytics, A/B testing, and surveys.
  • Detect, prevent, and respond to fraud, abuse, security incidents, and other harmful or illegal activity.
  • Comply with legal obligations, enforce our Terms of Sale and other agreements, and exercise or defend legal claims.
  • Carry out a corporate transaction such as a merger, acquisition, financing, reorganization, or sale of assets, including due diligence.

4. Legal Bases for Processing (EEA / UK)

If you are in the European Economic Area (EEA), the United Kingdom, or Switzerland, we process your personal information on the following legal bases under the GDPR / UK GDPR:

  • Performance of a contract — to take steps at your request before entering into a contract and to fulfill our pre-order and sale obligations to you.
  • Legitimate interests — to operate, secure, and improve the Site and our products; to prevent fraud; to communicate with customers; and to grow our business, where these interests are not overridden by your rights and freedoms.
  • Consent — for non-essential cookies, certain marketing messages (including SMS), and other activities where consent is required. You may withdraw consent at any time without affecting the lawfulness of prior processing.
  • Legal obligation — to comply with tax, accounting, consumer-protection, and other applicable laws.

5. How We Share Information

We share personal information with the following categories of recipients:

  • Service providers that operate the Site, host data, process payments, ship orders, send email and SMS, manage advertising, provide analytics, and support our customer service. These providers act on our instructions under written contracts.
  • Advertising and analytics partners such as Meta, Google, TikTok, and similar platforms. As described in Section 6, this sharing may be considered a “sale” or “sharing” of personal information under California and other U.S. state laws. We do not exchange personal information for money.
  • Professional advisors (lawyers, accountants, auditors, insurers) who provide services to us under duties of confidentiality.
  • Authorities and other parties where we believe in good faith that disclosure is required by law, regulation, or legal process; necessary to enforce our agreements; or necessary to protect our rights, property, or safety, or those of our customers or others.
  • Successors in interest in connection with a merger, acquisition, financing, reorganization, or sale of all or substantially all of our assets, with appropriate confidentiality protections.

We do not sell personal information for monetary consideration. We do disclose limited information to advertising partners as described in Section 6, which may qualify as a “sale” or “sharing” under certain U.S. state privacy laws.

6. Cookies, Pixels, and Online Advertising

6.1 What we use.

We and our partners use cookies, pixels, tags, SDKs, and similar technologies to operate the Site, remember your preferences, measure performance, and deliver and measure advertising. These include:

  • Strictly necessary — required for the Site to function (cart, checkout, security, account).
  • Performance and analytics — help us understand how the Site is used (e.g., Google Analytics).
  • Functional — remember your preferences (e.g., language, region).
  • Advertising and targeting — allow us and our ad partners (e.g., Meta Pixel, Google Ads, TikTok Pixel) to show you relevant ads on other sites and apps and to measure the performance of those ads.

6.2 Your choices.

You can control cookies through:

  • Our cookie banner / preference center, where available.
  • Your browser settings (most browsers let you block or delete cookies).
  • Industry opt-outs at optout.aboutads.info (Digital Advertising Alliance) and youronlinechoices.eu (EU).
  • Mobile device settings (Limit Ad Tracking on iOS, Reset Advertising ID on Android).

We honor the Global Privacy Control (GPC) signal as a valid request to opt out of “sale” or “sharing” of personal information for users of supported browsers and extensions, where required by law.

7. Email and SMS Marketing

7.1 Email.

If you provide your email address or place an order, we may send you marketing emails about products, launches, content, and offers. You can unsubscribe at any time using the link in any marketing email or by contacting us at hello@holonsound.com. Transactional messages about your order, the segregated account, balance charges, shipping, and warranty service are not marketing and may continue regardless of your marketing preferences.


7.2 SMS / text messaging.

If you opt in to SMS marketing (for example, by entering your mobile number and checking a consent box at checkout or on a sign-up form), you agree to receive recurring marketing text messages from us at the number provided, sent using an automatic telephone dialing system or similar technology. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies.

You can opt out of SMS marketing at any time by replying STOP to any message; we will send a single confirmation. Reply HELP for help, or contact us at hello@holonsound.com. Carriers are not liable for delayed or undelivered messages. By opting in, you confirm that you are the subscriber to, or authorized user of, the mobile number you provide.

8. Data Retention

We retain personal information only as long as needed to provide the Site, fulfill the purposes described in this Policy, and meet our legal, tax, accounting, and dispute-resolution obligations. For example, we typically retain order, deposit, and refund records for the period required by tax and consumer-protection law (often six to seven years), and customer support records for the duration of the relationship plus a reasonable archival period. When we no longer need personal information, we delete or de-identify it.

9. U.S. State Privacy Rights

Depending on where you live, you may have the following rights under state privacy laws (including, as applicable, California (CCPA/CPRA), Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Oregon (OCPA), Texas (TDPSA), Montana, Tennessee, Indiana, Iowa, Delaware, New Jersey, New Hampshire, Minnesota, Maryland, and others):

  • Right to know / access — request the categories or specific pieces of personal information we have collected about you.
  • Right to delete — request that we delete personal information we collected from you, subject to legal exceptions.
  • Right to correct — request correction of inaccurate personal information.
  • Right to portability — receive a copy of your personal information in a portable, readily usable format.
  • Right to opt out of the “sale” or “sharing” of personal information and of targeted advertising and certain profiling.
  • Right to limit use of sensitive personal information (California).
  • Right to non-discrimination for exercising your privacy rights.
  • Right to appeal a denial of your request, where applicable under your state’s law.

9.1 How to exercise your rights.

Submit a request by emailing hello@holonsound.com with the subject line “Privacy Rights Request.”  To opt out of the “sale” or “sharing” of personal information for cross-context behavioral advertising, you may also use the “Do Not Sell or Share My Personal Information” link on the Site footer or enable the Global Privacy Control in a supported browser. We will verify requests using information we already have on file (such as your order email and order number) and may ask for additional information to verify your identity.

9.2 Authorized agents.

You may use an authorized agent to submit a request on your behalf. We will require written authorization (for example, a signed permission) and may verify your identity directly.

9.3 California “Shine the Light.”

California residents may request information about the categories of personal information we share with third parties for those parties’ direct marketing purposes. We do not currently share personal information with third parties for their own direct marketing purposes. For inquiries, contact ____________.

We do not knowingly “sell” personal information for monetary consideration. The “Sold / Shared” column refers to disclosures to advertising partners that may be considered “sharing” for cross-context behavioral advertising under the CCPA/CPRA, and similar concepts under other state laws. You can opt out as described in Section 9.1.

10. EEA / UK Privacy Rights

If you are in the EEA, UK, or Switzerland, you have the following rights, subject to applicable law:

  • Access — confirm whether we process personal information about you and obtain a copy.
  • Rectification — correct inaccurate or incomplete information.
  • Erasure — request deletion in certain circumstances.
  • Restriction — restrict processing in certain circumstances.
  • Portability — receive your information in a structured, machine-readable format and transmit it to another controller.
  • Objection — object to processing based on legitimate interests or for direct marketing.
  • Withdraw consent — where processing is based on your consent.
  • Lodge a complaint with your local data protection authority. In the UK, that is the Information Commissioner’s Office (ico.org.uk). In Ireland, the Data Protection Commission (dataprotection.ie).

We do not engage in solely automated decision-making that produces legal or similarly significant effects.

11. International Data Transfers

We are based in the United States and may process and store personal information in the U.S. and other countries that may not provide the same level of data protection as your country. When we transfer personal information from the EEA, UK, or Switzerland to a country that has not received an adequacy decision, we use appropriate safeguards, including the European Commission’s Standard Contractual Clauses (and the UK Addendum or UK International Data Transfer Agreement, as applicable). 12. Security

We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction. No system is 100% secure, however, and we cannot guarantee the security of personal information transmitted over the internet. Please use a strong, unique password for your account and notify us promptly if you suspect any unauthorized use.

13. Children’s Privacy

The Site is not directed to children under 16, and we do not knowingly collect personal information from children under 16 (or under 13, where applicable under U.S. COPPA). If you believe a child has provided us with personal information, please contact hello@holonsound.com and we will take appropriate steps to delete the information.

14. Third-Party Sites and Services

The Site may contain links to third-party sites or include third-party services such as embedded videos, social media buttons, and chat widgets. We are not responsible for the privacy practices of those third parties. Please review their privacy policies before providing them with personal information.

15. Changes to This Policy

We may update this Policy from time to time. We will post the updated Policy on the Site with a new “Last updated” date. If the changes are material, we will provide additional notice (for example, by email or a prominent banner on the Site). Your continued use of the Site after the effective date constitutes acceptance of the updated Policy.
